A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without lawful basis.

"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation stems from a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his repatriation to the United States to face human smuggling charges, he was detained in immigration custody.

In her order, the court pointed out that the authorities does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."
